"Make sure you get lien waivers signed by the subcontractors," advises Frank Kowalkowski, shareholder at Davis & Kuelthau Law Firm in Green Bay. Kowalkowski has been handling construction-related disputes across Wisconsin for more than 20 years and represents contractors as well as home and commercial property owners. With the construction industry suffering under the pain of a faltering economy, disputes have been fairly common over the past five years. "Back when everyone was making money, disputes were much easier to fix. But in a horrible economy contractors have razor-thin margins to begin with – often bidding so low that there is no extra room for correction," Kowalkowski says. "As a result, you're going to see more pushback from builders because any dispute might cost them their entire profit."
