In the latest guidelines, OSHA and NIOSH recommended that contracts clearly describe the relationship between both parties and who is responsible for the safety. For example, the staffing firm is responsible for understanding the jobs and environments where they are placing employees, including any hazards or special conditions or circumstances. ey are responsible for general training to ensure employees recognize safety and health hazards. In addition, if some jobs require additional training before the job starts, then the staffing firm may be held responsible for that training. e manufacturing client has control of the worksite and day-to-day supervision and safety. erefore, the manufacturing company must provide first-day training and orientation, just as it provides for its regular employees. And on an ongoing basis, the manufacturer must provide temporary employees with safety training that is identical or equivalent to the training provided to regular employees performing the same or similar work. Also, employers that expose workers to certain workplace hazards have added responsibility to train temporary workers accordingly. ese hazards might include blood-borne pathogens, hearing conservation, hazard communications, respiratory protection, and control of lock-out/ tag-out. Both the staffing firm and the manufacturing company should work together to manage the risk of injury and confirm who is responsible for what part of the initial training and ongoing training. e landscape of temporary employee safety has changed dramatically since OSHA launched its Temporary Worker Initiative (TWI) in April 2013. Employers need to be aware of the risk and treat all employees, temporary or not, with a true commitment to workplace safety and reduce workplace injury.
